1.2 Spam and Unsolicited Communications

Prohibited activities include:

• Sending unsolicited bulk email (spam)
• Operating open mail relays or proxies
• Harvesting email addresses or personal information
• Phishing or fraudulent email schemes
• Distributing malware, viruses, or malicious code

1.3 Network Abuse

You may not:

• Launch DDoS attacks or participate in network attacks
• Engage in port scanning, network probing, or unauthorized access attempts
• Interfere with or disrupt network services or infrastructure
• Use excessive bandwidth that impacts other customers
• Operate services that consume disproportionate resources

1.4 Content Restrictions

Prohibited content includes:

• Child exploitation material or illegal pornography
• Content that incites violence or hatred
• Defamatory, libelous, or slanderous content
• Content that violates intellectual property rights
• Gambling or betting sites (where prohibited by law)

2. Resource Usage

You must use resources allocated to your VPS plan responsibly. Prohibited resource usage includes:

• Sustained CPU usage exceeding 80% for extended periods (unless on a dedicated CPU plan)
• Excessive I/O operations that impact shared storage systems
• Running cryptocurrency mining operations (unless explicitly permitted)
• Operating resource-intensive applications without appropriate plan upgrades
• Using shared resources in a manner that affects other customers

3. Security Requirements

You are responsible for:

• Maintaining secure passwords and authentication methods
• Keeping software and systems updated with security patches
• Implementing appropriate firewall and security configurations
• Not sharing account credentials with unauthorized parties
• Reporting security vulnerabilities or breaches immediately
• Ensuring your VPS is not compromised or used for malicious purposes

4. Intellectual Property

You may not use our services to infringe upon the intellectual property rights of others, including copyrights, trademarks, patents, or trade secrets. We will respond to valid DMCA takedown notices and other intellectual property complaints in accordance with applicable law.

5. System and Network Integrity

You may not:

• Attempt to gain unauthorized access to MediaVPS systems or networks
• Interfere with or disrupt the integrity or performance of our infrastructure
• Circumvent security measures or access controls
• Use automated tools to probe, scan, or test system vulnerabilities
• Modify or tamper with system configurations without authorization

6. Email and Communication

Email usage restrictions:

• No sending of unsolicited bulk email (spam)
• Compliance with CAN-SPAM Act and similar regulations
• Proper authentication (SPF, DKIM, DMARC) for outgoing mail
• No operation of open mail relays
• Reasonable sending limits to prevent abuse

7. Backup and Data Storage

While we provide backup services for certain plans, you are responsible for maintaining your own backups. You may not use our services as a primary backup solution for large amounts of data unrelated to your hosted services. Storage must be used in accordance with your plan's allocated resources.

8. Monitoring and Enforcement

MediaVPS reserves the right to monitor network traffic and system usage to ensure compliance with this AUP. We may investigate violations, suspend or terminate accounts, remove content, and cooperate with law enforcement as necessary. We are not obligated to provide warnings before taking action.

9. Reporting Violations

If you become aware of any violation of this AUP, please report it immediately to [email protected]. Include as much detail as possible, including evidence of the violation. We will investigate all reports promptly and take appropriate action.

10. Consequences of Violation

Violations of this AUP may result in:

• Immediate suspension or termination of your account
• Removal of violating content or services
• Forfeiture of prepaid fees (no refunds for policy violations)
• Legal action and cooperation with law enforcement
• Reporting to relevant authorities or organizations

11. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will be communicated via email or through our service dashboard. Continued use of our services after changes constitutes acceptance of the updated policy.
