Please read these Terms of Service carefully before using MediaVPS services. By accessing or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing and using MediaVPS services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
MediaVPS provides Virtual Private Server (VPS) hosting services, cloud infrastructure, and related technical support. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify MediaVPS of any unauthorized use of your account or any other breach of security.
4. Payment Terms
All services are billed in advance on a monthly or annual basis. Payment is due on the billing date specified in your account. Failure to pay may result in service suspension or termination. All fees are non-refundable unless otherwise stated in our refund policy.
5. Service Level Agreement (SLA)
We guarantee 99.9% uptime for all VPS services. If we fail to meet this guarantee, you may be eligible for service credits as outlined in our SLA documentation. The SLA does not apply to scheduled maintenance, force majeure events, or issues caused by customer actions.
6. Acceptable Use Policy
You agree to use our services only for lawful purposes and in accordance with our Acceptable Use Policy. Prohibited activities include but are not limited to: spamming, phishing, malware distribution, copyright infringement, and any activity that violates applicable laws.
7. Resource Usage and Limitations
Each VPS plan includes specific resource allocations (CPU, RAM, storage, bandwidth). Excessive resource usage that impacts other customers or our infrastructure may result in service throttling, suspension, or termination. Fair use policies apply to all plans.
8. Data Backup and Loss
While we provide backup services for certain plans, you are ultimately responsible for maintaining your own backups. MediaVPS is not liable for any data loss, corruption, or unavailability. We recommend maintaining independent backups of all critical data.
9. Intellectual Property
All content, trademarks, and intellectual property on MediaVPS services are the property of MediaVPS or its licensors. You may not reproduce, distribute, or create derivative works without express written permission.
10. Limitation of Liability
To the maximum extent permitted by law, MediaVPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
11. Termination
Either party may terminate service at any time. MediaVPS reserves the right to suspend or terminate accounts that violate these terms, engage in illegal activities, or fail to pay fees. Upon termination, all data may be permanently deleted.
12. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated via email or through our service dashboard. Continued use of our services after changes constitutes acceptance of the new terms.
13. Governing Law
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or our services shall be resolved through binding arbitration or in the appropriate courts.
